1. Introduction

These Terms of Service ("Terms") govern your use of LoreMind, an AI-powered NPC intelligence API service operated by Peek, LLC ("we," "our," or "us"). By accessing or using LoreMind, you agree to be bound by these Terms.

If you are using LoreMind on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

LoreMind provides AI-powered NPC intelligence for game developers. Our service includes:

  • API endpoints for NPC interactions
  • Lore document storage and semantic search
  • Entity Minds (AI NPC configurations)
  • Long-term memory for NPCs
  • Dashboard for project management

3. Eligibility

To use LoreMind, you must:

  • Be at least 18 years old, or have parental/guardian consent
  • Provide accurate and complete registration information
  • Have the legal capacity to enter into binding agreements
  • Not be prohibited from using the service under applicable laws

4. Account Terms

You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access
  • Keeping your contact information current

You may not share accounts between multiple users or create multiple accounts to circumvent restrictions.

5. Payment Terms

5.1 Credits

LoreMind operates on a pay-per-use credits model. Credits are consumed when you make API calls for NPC interactions and other services.

5.2 Purchases

You may purchase credits through our dashboard. All purchases are processed by Stripe. Prices are displayed in US dollars unless otherwise indicated.

5.3 Refunds

Credits are generally non-refundable. We may provide refunds at our discretion for service issues or as required by applicable law. Unused credits do not expire.

5.4 Auto-Reload

If you enable auto-reload, your payment method will be automatically charged when your credit balance falls below a threshold you configure. You may disable auto-reload at any time through your dashboard.

6. API Usage

6.1 Rate Limits

API usage is subject to rate limits that vary by project configuration. Rate limits help ensure service stability for all users. You may request increased limits by contacting support.

6.2 Prohibited Uses

You may not use LoreMind to:

  • Reverse engineer, decompile, or attempt to extract our source code
  • Interfere with or disrupt the service or servers
  • Circumvent rate limits or security measures
  • Resell or redistribute the service without authorization
  • Generate content that violates laws or third-party rights
  • Create content promoting violence, hate, or illegal activities
  • Harass, abuse, or harm others

7. Content

7.1 Your Content

You retain ownership of content you upload to LoreMind, including lore documents, NPC configurations, and project settings. By uploading content, you grant us a license to use, store, and process it to provide the service.

7.2 Content Restrictions

Your content must not:

  • Infringe intellectual property rights of others
  • Contain illegal or harmful material
  • Violate privacy rights of any person
  • Contain malware or malicious code

7.3 Generated Content

NPC responses generated through LoreMind are licensed to you for use in your games and applications. You are responsible for reviewing generated content before presenting it to end users.

8. AI Service Disclaimers

LoreMind uses artificial intelligence to generate NPC responses. You understand that:

  • AI-generated content may not always be accurate or appropriate
  • We do not guarantee that responses will be factually correct
  • AI models may occasionally produce unexpected or inappropriate outputs
  • You are responsible for implementing content filtering if needed
  • Generated content should not be treated as professional advice

9. Data Responsibilities

9.1 Your Data

You retain ownership of your lore content and project data. We process your data in accordance with our Privacy Policy.

9.2 Player Data

When using LoreMind in your games, we process data about your players on your behalf. You are responsible for:

  • Informing your players about data collection
  • Obtaining any required consents
  • Complying with applicable privacy laws (GDPR, CCPA, etc.)
  • Managing player data deletion requests

10. Intellectual Property

10.1 Our Property

LoreMind, including our platform, APIs, documentation, branding, and underlying technology, is owned by Peek, LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

10.2 Your Property

You retain all rights to your original content, including your game's lore, characters, and creative works that you upload to LoreMind.

11. Termination

11.1 By You

You may stop using LoreMind at any time. To delete your account, contact support or use the account deletion feature in your dashboard. Unused credits are not refunded upon termination.

11.2 By Us

We may suspend or terminate your access if:

  • You violate these Terms
  • Your account shows signs of fraud or abuse
  • Required by law
  • We discontinue the service (with reasonable notice)

11.3 Data Export

Before termination, you may export your data using our export features or by contacting support.

12. Disclaimer of Warranties

LOREMIND IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEEK, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF LOREMIND. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Peek, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of LoreMind
  • Your content or your end users' use of your applications
  • Your violation of these Terms
  • Your violation of any third-party rights

15. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of LoreMind shall be resolved in the state or federal courts located in Florida.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on our service at least 30 days before they take effect. Your continued use of LoreMind after changes constitutes acceptance of the updated Terms.

17. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Peek, LLC.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce any right does not constitute a waiver of that right.
  • Assignment: You may not assign these Terms without our written consent.
